These activities do not constitute health services within the meaning of the provisions of the Medical Activities Act.<\/span><\/li><li class=\"c60 li-bullet-1\"><span class=\"c3\">Tasks that can be carried out by the Treatment Entity include:<\/span><\/li><\/ol><ol class=\"c9 lst-kix_list_15-1 start\" start=\"1\"><li class=\"c43 li-bullet-0\"><span class=\"c3\">the provision of outpatient specialist health services, including in particular diagnostics and treatment in general and vascular surgery;<\/span><\/li><li class=\"c40 li-bullet-1\"><span class=\"c3\">providing individual advice and consultation;<\/span><\/li><li class=\"c100 c53 li-bullet-1\"><span class=\"c3\">matching medical devices to patients' needs;<\/span><\/li><li class=\"c51 c53 li-bullet-1\"><span class=\"c3\">teaching patients how to use medical devices;<\/span><\/li><li class=\"c7 li-bullet-0\"><span class=\"c3\">promoting health-promoting behaviour and shaping and maintaining fitness and performance in people of all ages in order to prevent disability;<\/span><\/li><li class=\"c40 li-bullet-1\"><span class=\"c3\">patient education.<\/span><\/li><\/ol><p class=\"c32\"><span class=\"c0\">\u00a7 3<br \/><\/span><span style=\"font-size: 11pt; font-style: normal; font-weight: bold;\">TYPE OF TREATMENT ACTIVITY<br \/><\/span><span style=\"font-size: 11pt; font-style: normal; font-weight: bold;\">AND THE RANGE OF HEALTH SERVICES PROVIDED<\/span><\/p><ol class=\"c9 lst-kix_list_14-0 start\" start=\"1\"><li class=\"c2 li-bullet-1\"><span class=\"c3\">The Treatment Entity carries out therapeutic activities in the type of outpatient health services.<\/span><\/li><li class=\"c41 li-bullet-0\"><span class=\"c3\">The Medical Entity, as part of its activities, provides health services in the field of specialist outpatient treatment (HC.1.3.3.) - vascular surgery (39). An organisational unit called the Centre for the Prevention and Treatment of Vascular Diseases (hereinafter: \"<\/span><span class=\"c0\">Organisational unit<\/span><span class=\"c3\">\").<\/span><\/li><li class=\"c12 li-bullet-1\"><span class=\"c3\">The Treatment Facility and Business Unit is located at: Edward Habich Street 12\/LU5, 02<\/span><\/li><\/ol><p class=\"c72\"><span class=\"c3\">- 495 Warsaw.<\/span><\/p><ol class=\"c9 lst-kix_list_13-0\" start=\"3\"><li class=\"c72 c102 li-bullet-1\"><span class=\"c3\">There are no separate organisational units in the Treatment Unit.<\/span><\/li><li class=\"c97 li-bullet-0\"><span class=\"c3\">The Treatment Entity includes the Reception and Administration as an auxiliary organisational unit. Within this cell: employee records are kept; reports and statistics are prepared, commissioned and resulting from separate regulations; draft responses to external letters are prepared, including letters from public administration bodies.<\/span><\/li><li class=\"c52 li-bullet-0\"><span class=\"c3\">The detailed scope of activities of the employees or associates of the Treatment Entity shall be specified in particular in the employment contract, contract of mandate or cooperation agreement, as well as the list of duties of the employees or associates.<\/span><\/li><li class=\"c11 li-bullet-0\"><span class=\"c3\">The Entity is managed and represented externally by the partners representing the Medical Entity in accordance with the articles of association and the provisions of \u00a7 9 of the By-Laws.<\/span><\/li><li class=\"c27 li-bullet-0\"><span class=\"c3\">The Treatment Facility and the Organisational Unit and the persons employed in them work together to ensure the smooth and efficient functioning of the Treatment Facility in terms of diagnostic and therapeutic as well as administrative and economic aspects.<\/span><\/li><li class=\"c16 li-bullet-0\"><span class=\"c3\">Interaction is carried out in compliance with generally applicable legislation and with respect for patient rights.<\/span><\/li><li class=\"c2 li-bullet-1\"><span class=\"c3\">The following posts operate in the Treatment Facility:<\/span><\/li><\/ol><ol class=\"c9 lst-kix_list_13-1 start\" start=\"1\"><li class=\"c51 c53 li-bullet-1\"><span class=\"c3\">Manager\/Director;<\/span><\/li><li class=\"c51 c53 li-bullet-1\"><span class=\"c3\">Doctor\/Doctor;<\/span><\/li><li class=\"c50 li-bullet-1\"><span class=\"c3\">Nurse Practitioner\/Nurse;<\/span><\/li><li class=\"c51 c53 li-bullet-1\"><span class=\"c3\">Support staff (reception).<\/span><\/li><\/ol><ol class=\"c9 lst-kix_list_13-0\" start=\"10\"><li class=\"c31 li-bullet-1\"><span class=\"c3\">Persons holding individual positions in the Treatment Facility, carry out the following duties:<\/span><\/li><\/ol><ol class=\"c9 lst-kix_list_13-1 start\" start=\"1\"><li class=\"c50 li-bullet-1\"><span class=\"c3\">Manager\/Director:<\/span><\/li><\/ol><ol class=\"c9 lst-kix_list_13-2 start\" start=\"1\"><li class=\"c51 c55 li-bullet-1\"><span class=\"c3\">organising and directing the work of the staff of the Treatment Facility;<\/span><\/li><li class=\"c26 c59 li-bullet-0\"><span class=\"c3\">approval of investment, recovery and audit plans;<\/span><\/li><li class=\"c51 c85 li-bullet-0\"><span class=\"c3\">issuing internal normative acts;<\/span><\/li><li class=\"c4 li-bullet-0\"><span class=\"c3\">issuing authorisations and powers of attorney;<\/span><\/li><li class=\"c8 li-bullet-0\"><span class=\"c3\">appearing on behalf of the Healthcare Provider before authorities, courts and administrative bodies;<\/span><\/li><li class=\"c68 c77 li-bullet-0\"><span class=\"c3\">concluding contracts for medical services and entering into civil law contracts for the benefit of the Medical Entity;<\/span><\/li><li class=\"c30 li-bullet-0\"><span class=\"c3\">Establishing cooperation (conclusion of employment contracts or service contracts) with the staff of the Treatment Entity;<\/span><\/li><li class=\"c17 li-bullet-0\"><span class=\"c3\">public speaking and working with the media.<\/span><\/li><\/ol><ol class=\"c9 lst-kix_list_13-1\" start=\"2\"><li class=\"c51 c53 li-bullet-1\"><span class=\"c3\">Doctor\/Doctor:<\/span><\/li><\/ol><ol class=\"c9 lst-kix_list_13-2 start\" start=\"1\"><li class=\"c51 c55 li-bullet-1\"><span class=\"c3\">carrying out consultations and procedures in the field of general surgery;<\/span><\/li><li class=\"c1 li-bullet-0\"><span class=\"c3\">carrying out vascular surgery consultations and procedures;<\/span><\/li><li class=\"c51 c85 li-bullet-0\"><span class=\"c3\">selecting medical devices;<\/span><\/li><li class=\"c4 li-bullet-0\"><span class=\"c3\">patient education<\/span><\/li><\/ol><ul class=\"c9 lst-kix_list_12-0 start\"><li class=\"c95 c110 li-bullet-2\"><span class=\"c3\">in accordance with the requirements of knowledge and with due diligence.<\/span><\/li><\/ul><ol class=\"c9 lst-kix_list_13-1 start\" start=\"1\"><li class=\"c51 c53 li-bullet-1\"><span class=\"c3\">Nurse Practitioner\/Nurse:<\/span><\/li><\/ol><ol class=\"c9 lst-kix_list_13-2 start\" start=\"1\"><li class=\"c51 c55 li-bullet-1\"><span class=\"c3\">performing nursing activities;<\/span><\/li><li class=\"c28 li-bullet-0\"><span class=\"c3\">cooperation with the staff of the Treatment Facility;<\/span><\/li><li class=\"c64 li-bullet-3\"><span class=\"c3\">implementation of medical orders;<\/span><\/li><li class=\"c28 li-bullet-0\"><span class=\"c3\">Monitoring the status and ongoing replenishment of medicines, medical supplies and materials;<\/span><\/li><li class=\"c34 li-bullet-4\"><span class=\"c3\">inspecting, maintaining the medical equipment and apparatus of the Treatment Facility in working order and ready for use;<\/span><\/li><li class=\"c64 li-bullet-0\"><span class=\"c3\">maintenance of nursing records;<\/span><\/li><li class=\"c39 li-bullet-1\"><span class=\"c3\">selecting medical devices;<\/span><\/li><li class=\"c17 li-bullet-0\"><span class=\"c3\">patient education<\/span><\/li><\/ol><ul class=\"c9 lst-kix_list_12-0\"><li class=\"c105 li-bullet-2\"><span class=\"c3\">in accordance with the requirements of knowledge and with due diligence.<\/span><\/li><\/ul><ol class=\"c9 lst-kix_list_13-1 start\" start=\"1\"><li class=\"c51 c53 li-bullet-1\"><span class=\"c3\">Support staff (Reception and administration):<\/span><\/li><\/ol><ol class=\"c9 lst-kix_list_13-2 start\" start=\"1\"><li class=\"c55 c95 li-bullet-1\"><span class=\"c3\">making appointments (including by telephone and online);<\/span><\/li><li class=\"c59 c61 li-bullet-0\"><span class=\"c3\">creation of visit schedules;<\/span><\/li><li class=\"c18 li-bullet-3\"><span class=\"c3\">registration of patients of the Treatment Facility;<\/span><\/li><li class=\"c28 li-bullet-4\"><span class=\"c3\">keeping the necessary records;<\/span><\/li><li class=\"c17 li-bullet-0\"><span class=\"c3\">receiving and dispatching correspondence and courier deliveries;<\/span><\/li><li class=\"c64 c68 li-bullet-4\"><span class=\"c3\">To carry out activities related to the supply of necessary resources, including medical supplies and materials, and necessary external services to the Treatment Facility;<\/span><\/li><li class=\"c39 li-bullet-1\"><span class=\"c3\">other technical and administrative support.<\/span><\/li><\/ol><p class=\"c19\"><span class=\"c0\">\u00a7 5.<br \/><\/span><span style=\"font-size: 11pt; font-style: normal; font-weight: bold;\">PLACE OF SUPPLY OF HEALTH SERVICES<\/span><\/p><ol class=\"c9 lst-kix_list_11-0 start\" start=\"1\"><li class=\"c42 li-bullet-4\"><span class=\"c3\">Health services are provided in the premises of the Treatment Facility and Organisational Unit, located at 12\/LU5 Edwarda Habicha Street, 02 - 495 Warsaw.<\/span><\/li><li class=\"c88 li-bullet-4\"><span class=\"c3\">The Treatment Entity may provide specialised health services to other treatment entities in accordance with the contracts concluded.<\/span><\/li><\/ol><p class=\"c19\"><span class=\"c0\">\u00a7 6.<br \/><\/span><span style=\"font-size: 11pt; font-style: normal; font-weight: bold;\">ORGANISATION AND DELIVERY OF HEALTH SERVICES, PAYMENT FOR HEALTH SERVICES<\/span><\/p><ol class=\"c9 lst-kix_list_10-0 start\" start=\"1\"><li class=\"c68 c107 li-bullet-0\"><span class=\"c3\">The Treatment Facility shall provide health services within the scope defined in the Regulations with ensuring proper accessibility and quality of services in the Treatment Facility and its subordinate structures, in a manner that guarantees the most convenient form of use of services for patients, taking into account the requirements set out by law, in particular with regard to respecting patient rights, and the principles arising from medical procedures and standards.<\/span><\/li><li class=\"c109 c68 li-bullet-0\"><span class=\"c3\">Health services are provided by physicians employed by the Medical Entity or cooperating with the Medical Entity on the basis of civil law contracts.<\/span><\/li><li class=\"c65 li-bullet-3\"><span class=\"c3\">The patient receiving healthcare services provided by the Treatment Entity is entitled to all patient rights reserved in generally applicable laws, in particular the Act on Patient's Rights and Patient's Rights Ombudsman. The Treatment Entity shall make the content of the aforementioned Act available at the patient's request.<\/span><\/li><li class=\"c68 c109 li-bullet-4\"><span class=\"c3\">For healthcare services provided against payment, the Treatment Provider shall issue a bill detailing, at the patient's request, the diagnostic and therapeutic procedures carried out.<\/span><\/li><li class=\"c2 li-bullet-1\"><span class=\"c3\">The amount of fees for health services is shown <\/span><span class=\"c0\">Annex 1 <\/span><span class=\"c3\">to the Rules of Procedure.<\/span><\/li><\/ol><p class=\"c19\"><span class=\"c0\">\u00a7 7.<br \/><\/span><span style=\"font-size: 11pt; font-style: normal; font-weight: bold;\">MODALITIES OF INTERACTION WITH OTHER TREATMENT PROVIDERS<\/span><\/p><ol class=\"c9 lst-kix_list_9-0 start\" start=\"1\"><li class=\"c14 li-bullet-4\"><span class=\"c3\">The Treatment Entity may cooperate in the provision of services to patients with other treatment providers on the basis of a separate cooperation agreement.<\/span><\/li><li class=\"c5 li-bullet-3\"><span class=\"c3\">Interaction with other healthcare providers may concern, in particular, ensuring the correct diagnosis, treatment and rehabilitation of patients and the continuity of the healthcare delivery process.<\/span><\/li><li class=\"c106 li-bullet-4\"><span class=\"c3\">The Treatment Entity may make patients' medical records available to healthcare providers if the records are necessary to ensure the continuity of healthcare services, subject to paragraph 4.<\/span><\/li><li class=\"c5 li-bullet-0\"><span class=\"c3\">The interaction and possible release of medical records shall respect the generally applicable legislation and the rights of the patient.<\/span><\/li><\/ol><p class=\"c19\"><span class=\"c0\">\u00a7 8.<br \/><\/span><span style=\"font-size: 11pt; font-style: normal; font-weight: bold;\">RULES ON THE KEEPING OF MEDICAL RECORDS AND THE CHARGING OF FEES FOR MAKING THEM AVAILABLE<\/span><\/p><ol class=\"c9 lst-kix_list_8-0 start\" start=\"1\"><li class=\"c27 li-bullet-4\"><span class=\"c3\">The Treatment Entity maintains and makes available the medical records of patients receiving healthcare services provided by the Treatment Entity in accordance with the rules of law.<\/span><\/li><li class=\"c67 li-bullet-0\"><span class=\"c3\">The Treatment Entity shall provide access to medical records on the basis of a request for access to medical records submitted by a person authorised in accordance with generally applicable law.<\/span><\/li><li class=\"c98 li-bullet-0\"><span class=\"c3\">A person requesting access to medical records may use the model request for medical records which is a <\/span><span class=\"c0\">Annex 2 <\/span><span class=\"c3\">to the Rules of Procedure.<\/span><\/li><li class=\"c99 li-bullet-0\"><span class=\"c3\">Medical records may only be released on condition that the identity of the person requesting them is first verified.<\/span><\/li><li class=\"c2 li-bullet-1\"><span class=\"c3\">The Treatment Provider shall make the medical records available free of charge.<\/span><\/li><li class=\"c49 li-bullet-0\"><span class=\"c3\">The release of records shall be carried out in such a way as to ensure confidentiality and the protection of personal data.<\/span><\/li><\/ol><p class=\"c62\"><span class=\"c0\">\u00a7 9.<br \/><\/span><span style=\"font-size: 11pt; font-style: normal; font-weight: bold;\">THE MANAGEMENT OF ORGANISATIONAL UNITS AND DEPARTMENTS<\/span><\/p><ol class=\"c9 lst-kix_list_7-0 start\" start=\"1\"><li class=\"c68 c93 li-bullet-0\"><span class=\"c3\">The entity responsible for the management of the organisational units and the organisational units separated in the Treatment Facility is the Manager of the Treatment Facility.<\/span><\/li><li class=\"c68 c92 li-bullet-0\"><span class=\"c3\">The managers of the Treatment Facility are the partners representing AC MEDICAL T. CI\u0104\u0106KA SP\u00d3\u0141KA KOMANDYTOWA, based in Stara Wie\u015b.<\/span><\/li><li class=\"c82 li-bullet-0\"><span class=\"c3\">The Head of the Treatment Facility may appoint a person responsible for the organisation of activities at the level of individual organisational units separate from the Treatment Facility.<\/span><\/li><li class=\"c68 c78 li-bullet-0\"><span class=\"c3\">The Manager of the Treatment Facility may authorise the persons referred to in paragraph 3 above to carry out the following activities:<\/span><\/li><\/ol><ol class=\"c9 lst-kix_list_7-1 start\" start=\"1\"><li class=\"c56 c108 li-bullet-1\"><span class=\"c3\">Directing the work of a subordinate part (or all) of an organisational unit;<\/span><\/li><li class=\"c95 c56 li-bullet-1\"><span class=\"c3\">personnel management of the organisational unit;<\/span><\/li><li class=\"c68 c71 li-bullet-0\"><span class=\"c3\">the distribution of tasks (including permanent tasks) and the means to carry them out, taking into account their rank, priority, professional qualifications and the day-to-day workload of the direct performers;<\/span><\/li><li class=\"c6 li-bullet-1\"><span class=\"c3\">supervise the efficiency and effectiveness of the work organisation;<\/span><\/li><li class=\"c51 c56 li-bullet-1\"><span class=\"c3\">supervising the performance of the organisational unit's staff in their individual tasks;<\/span><\/li><li class=\"c51 c56 li-bullet-1\"><span class=\"c3\">providing explanations and professional guidance to staff;<\/span><\/li><li class=\"c89 li-bullet-0\"><span class=\"c3\">supervision of staff working conditions, with particular reference to designated sanitary procedures;<\/span><\/li><li class=\"c117 li-bullet-0\"><span class=\"c3\">supervise compliance by subordinate staff with the law, internal normative acts and ethical standards in force;<\/span><\/li><li class=\"c56 c111 li-bullet-1\"><span class=\"c3\">to propose the reward or punishment of staff in the organisational unit;<\/span><\/li><li class=\"c51 c56 li-bullet-1\"><span class=\"c3\">to put forward proposals for improving the work.<\/span><\/li><\/ol><h1 class=\"c48\"><span class=\"c0\">\u00a7 9A. MONITORING<\/span><\/h1><ol class=\"c9 lst-kix_list_6-0 start\" start=\"1\"><li class=\"c70 c68 li-bullet-0\"><span class=\"c3\">There is video surveillance of the public room where the Reception is located and of the lobby within the Treatment Facility and Unit.<\/span><\/li><li class=\"c68 c87 li-bullet-3\"><span class=\"c3\">Monitoring shall not extend to premises other than those indicated in paragraph 1 above, including, in particular, premises where health services are provided.<\/span><\/li><li class=\"c68 c113 li-bullet-0\"><span class=\"c3\">The purpose of monitoring is to ensure the safety of patients, employees and associates of the Healthcare Provider.<\/span><\/li><li class=\"c68 c70 li-bullet-4\"><span class=\"c3\">The Treatment Facility Manager is responsible for the use of monitoring in accordance with the principles of the law, including the implementation of data protection obligations.<\/span><\/li><\/ol><p class=\"c62\"><span class=\"c0\">\u00a7 10.<br \/><\/span><span style=\"font-size: 11pt; font-style: normal; font-weight: bold;\">FINAL PROVISIONS<\/span><\/p><ol class=\"c9 lst-kix_list_5-0 start\" start=\"1\"><li class=\"c68 c75 li-bullet-4\"><span class=\"c3\">To the extent not regulated by these Terms and Conditions, the generally applicable provisions of Polish law shall apply.<\/span><\/li><li class=\"c112 li-bullet-0\"><span class=\"c3\">The provisions of the Rules apply to all staff of the Treatment Facility and to all patients of the Treatment Facility.<\/span><\/li><li class=\"c92 c68 li-bullet-4\"><span class=\"c3\">The Rules and Regulations together with the annexes constitute an integral whole.
